The breaks that we have according to art. 24 in our collective convention is time at our disposal, we choose what we want to do during these breaks, we are not available to the company.
Our convention
art. 24 states the following about breaks.
When the
daily shift has a continuous duration, or any of the sections if it is a split
shift, of between four or more hours and less than six hours, there will be a
break of 10 minutes, considered as effective work time.
In the same
way, if the daily working day of continuous duration, or any of the sections if
it is a split working day, is between 6 and 8 hours, said break will be 20
minutes considered as effective working time.
If,
finally, the daily shift has a continuous duration, or any of the sections if
it is a split shift, is greater than 8 hours, the break will be 30 minutes
considered as effective working time.
The
distribution and manner of carrying out the previously established breaks will
correspond to the company, organizing them in a logical and rational way based
on the needs of the service, without the breaks being able to be established
before they have elapsed:
• 2 hours
from the start of the day
• or after 90
minutes or less until the conclusion of this.
This means
that if we have a split shift and the first section is 4 hours and the second
section is 4 hours, we have two 10-minute breaks.
If the
first section is 4 and a half hours and the second is 3 and a half hours, we
have 10 minutes break in the first section, we do not have the right to a break
in the second section because there are not 4 hours of work.
These
breaks cannot be confused with breaks in PVD (Data Display Screens) art. 54 of
the convention.
The breaks
in PVD that we have according to art. 54 of the convention, is time at the
disposal of the company, that is, the company may decide what to do during
these breaks.
The breaks
in PVD according to the convention art. 54 cannot be combined with breaks
according to art. 24 of the convention.
The
agreement art. 54 states the following about breaks in PVD.
Article
54.- Breaks in PVD.
In addition
to the breaks indicated in Article 24 of this convention, and without being
cumulative to them, and also with the consideration of effective working time,
operations personnel who carry out their activity on data display screens will
have a break of five minutes for each hour of effective work.
These breaks
cannot be cumulative with each other.
The company
will be responsible for the distribution and way of carrying out these breaks,
organizing them in a logical and rational way according to the needs of the
service, without such breaks being able to delay, or advance, their start more
than 15 minutes compared to when they comply with the hours set for its
execution.
