You have a “obra
o servicio” contract and you are being offered another position in another project
because your current position is being closed by the client.
If this is
the case the company do have to give you a “indefinido”, fixed contract.
What if the
offer you are receiving do not have the same conditions?
You do have
the right to insist on having the same conditions, but if the company cannot
meet your requirements the contract will be ended.
Can you
sign the new contract with “no conforme”?
As a
contract is an agreement between the employee end the employer, you cannot sign
it with “no conforme”, a contract, as it is an agreement, you either sign if
you agree, or you do not sign if you do not agree, and if you do not sign you
will not get the position you are being offered.
